Employer terms of business
These terms apply when you register a company or a recruitment agency on the EDWartens employer portal. Using EDWartens is free for employers and agencies. Please read them with our privacy notice. Version 2026-10-22.
Last updated 23 October 2026
1. Who we are
EDWartens UK is a trading name of Wartens Ltd, a company registered in England and Wales (company number 15262249), registered office 8 Lyon Road, Milton Keynes MK1 1EX. Contact: info@wartens.com. In these terms "we" means Wartens Ltd and "you" means the company that registers, and its team members.
2. The service is free
- There is no fee to register, to post a job, to search the talent pool, to ask us for a shortlist, to receive applications or to hire a candidate.
- There is no placement fee, introduction fee, success fee or subscription, and we do not take commission from you or from the candidate.
- You never have to buy training or anything else from us to use the service.
- If this ever changes we will tell you in writing at least 30 days before, and the change will not apply to candidates we introduced before it.
3. Our role as an employment agency
When we introduce candidates to you, we act as an employment agency within the meaning of the Employment Agencies Act 1973 and the Conduct of Employment Agencies and Employment Businesses Regulations 2003 (the Regulations). That means we find and introduce work-seekers to hirers with a view to you engaging them directly. We are not the employer or the engager of any candidate, we do not supply temporary workers, and we do not check or guarantee a candidate's suitability beyond what the certificates and results we issue show.
- We never charge candidates. No candidate pays us to be found, shortlisted, introduced or placed, and no introduction depends on a candidate buying a course or any other product.
- We pass a candidate's details to you only when the candidate applies to your job, or accepts your request to contact them, or agrees to an introduction we propose.
- We keep a record of introductions, contact requests, applications and the agreements behind them for 12 months after we last provide a service to you, then delete or anonymise them unless the law requires us to keep them longer.
- Your company's first job is reviewed by our team before it is public. After that, jobs from a verified company may go live straight away once our automatic checks pass, and our team checks them afterwards. We may refuse, edit with your agreement, or remove a job that does not meet these terms, and we may switch instant publishing off for any account.
- The Fair Work Agency enforces the Regulations (since 7 April 2026 it carries out the work of the former Employment Agency Standards Inspectorate).
4. Your responsibilities as a hirer
Right to work
You are responsible for checking, before anyone starts work, that they have the right to work in the UK, and for keeping the records the Immigration, Asylum and Nationality Act 2006 and Home Office guidance require. We do not carry out right-to-work checks for you. A candidate stating on their profile that they have the right to work is not a check.
Fair treatment (Equality Act 2010)
- Do not discriminate in an advert, a search, a shortlist, an interview or an offer because of age, disability, gender reassignment, marriage and civil partnership, pregnancy and maternity, race (including nationality and ethnic origin), religion or belief, sex or sexual orientation.
- Our adverts checker flags wording such as "young", "recent graduate", "digital native" and "native English speaker". You must confirm you have considered each flag before you submit, and our reviewers will check them again. Where a genuine occupational requirement applies, tell the reviewer.
- The talent pool has no filter or sort on age, sex, race, nationality, disability, religion, photo or name, and you must not try to work these out or to get around this.
- Consider reasonable adjustments for disabled candidates.
Honest adverts
- Post only real vacancies you intend to fill, with accurate pay, location and hours. Pay must meet the National Minimum Wage and National Living Wage; internships we host must be paid.
- Never ask a candidate to pay a fee, deposit or cost of any kind to apply for, be considered for or start a job. We will remove the advert and may close the account.
- We do not sponsor visas and never imply that we do. If your advert says you may sponsor a visa, you must hold a valid Home Office sponsor licence for that route and the statement must be true. Candidates are told that sponsorship labels are not a promise of a visa.
Applications, CVs, messages and interviews
- You see a candidate's CV only if they chose to share it with their application. Views of CVs are logged.
- Messages through the portal are for recruitment only. Do not ask for fees, bank details or identity documents by message. We keep messages for 12 months and may read a conversation that is reported to us or flagged by our checks.
- Interview invitations you send through the portal must be for a real role, with a real time and place or link.
- Expired jobs close automatically. You can renew an unchanged job; a changed job may be checked again.
Your public company page
Once your company is verified, it may have a public page on edwartens.co.uk showing your name, logo, short description, website and open jobs. You confirm you have the right to use the logo you upload. Ask us and we will hide the page.
5. Recruitment agencies
If you register as a recruitment agency, these extra terms apply:
- You are responsible for your own compliance with the Employment Agencies Act 1973 and the Regulations, and for holding any licence your work needs.
- For each job, say whether it is permanent (you act as an employment agency) or temporary (you act as an employment business). Adverts must show the job is posted by an agency and include the information regulation 27 requires: the nature of the work, its location, the minimum experience or qualifications needed, and the rate of pay. Jobs are labelled "Agency" on our site.
- You may name your client only with their agreement; otherwise describe them (for example "automotive manufacturer, Midlands").
- You can see and contact only candidates who chose to be visible to agencies, or who apply for your jobs. Shortlisting on request is for direct employers only.
- Never charge candidates any fee the law does not allow, and never make our service conditional on a candidate registering with you.
6. Candidate data and UK GDPR
- Candidates in the talent pool chose to be there, and can leave at any time. Until they apply or accept a contact request you see a limited card (skills, courses, certificates, results, broad UK region and availability) and not their name, email or phone number, unless they chose to be named and your company is verified.
- When a candidate applies to your job or accepts your request, you receive their name, email address, phone number if provided and profile. From then you are an independent controller of that personal data and must comply with the UK GDPR and the Data Protection Act 2018, including: having a lawful basis, giving the candidate your privacy notice, using the data only to consider them for that role (or other roles if they agree), keeping it secure, not sharing it with anyone who does not need it, and deleting it when you no longer need it. We suggest no longer than six months after a decision unless the candidate agrees.
- Do not copy, scrape, export or resell the talent pool, and do not use candidate details for marketing without the consent the law requires.
- We limit contact requests (a monthly limit per company, one open request per candidate and a 30-day pause after a decline) to protect candidates from unwanted contact.
- Tell us without delay if you become aware of a data breach involving details we gave you, and tell the ICO and the candidates yourself where the law requires you to.
- For employer account data (your team's names, work emails and job records) we are the controller. See our privacy notice.
7. Shortlisting on request
You can ask our team to shortlist candidates for a role. We choose from the talent pool and from applicants who have agreed to be introduced, and we ask each candidate's permission before sharing their details with you. This is free. We do not promise a number of candidates, a time, or that any candidate will suit you or accept an offer, and we may decline a request.
8. No guarantees
We do not guarantee that you will receive applications, find a candidate, or hire anyone, and candidates are not guaranteed a job or an interview. The service is provided as it is.
9. Your account
- We verify every new company, usually within one working day, and may ask for evidence such as a Companies House number or a work email on your company's domain. Until a company is verified it can draft jobs but cannot search the pool or contact candidates.
- You are responsible for your team's use of the portal. Keep passwords private and remove people who leave.
- We may suspend or close an account that breaks these terms or the law, or that harms candidates, and we will tell you why unless the law prevents it.
- You may close your account at any time by emailing info@wartens.com.
10. Our liability
Nothing in these terms limits liability that cannot be limited by law, including for death or personal injury caused by negligence, or for fraud. Subject to that, because the service is free, we are not liable for loss of profit, indirect or consequential loss, or for the decisions you take about hiring, and our liability is otherwise limited to the extent the law allows.
11. Changes, law and complaints
We may update these terms; the version and date are at the top of this page, and we will ask you to accept the new version when you next sign in. These terms are governed by the law of England and Wales and the courts of England and Wales have jurisdiction. If you are unhappy with the service, see our complaints procedure.
